1. The LUMINA Service

LUMINA is an AI-powered life co-pilot that provides personalised daily support, coaching, reflection, and companionship. LUMINA is operated by USHVIBES OÜ, a private limited company registered in Estonia.

The LUMINA service includes: AI conversation, Morning Illumination briefings, LUMINA Companion proactive messages, Life Scores, Dream Compass, Mood Weather, Echo poetry, Life Chapters, Living Memory, Resonance Score, and all other features described on our website or in the application.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

2. Eligibility

• You must be at least 18 years old to use LUMINA. By creating an account, you confirm you are 18 or older.
• You must provide accurate information during registration.
• You must not be prohibited from using our services under applicable law in your country.
• You may not create more than one account per person without our written permission.

If you are between 16 and 18 and your country's law permits, you may use LUMINA with verifiable parental consent. Contact us at legal@ushvibes.com to arrange this.

3. Your Account

Account security

• You are responsible for keeping your account credentials secure.
• You must notify us immediately at security@ushvibes.com if you suspect unauthorised access to your account.
• We are not liable for any loss resulting from unauthorised account access where you failed to maintain security.

Account accuracy

• You must keep your account information accurate and up to date.
• Providing false information — including false age — constitutes a breach of these Terms and may result in immediate account termination.

4. Plans and Payment

Free plan (MVP)

LUMINA offers a free plan that includes limited conversations, 3 Companion nudges per day, text Morning Illumination, Daily Spark, 8-dimension life scoring, and other features as described in the application. The free plan is provided indefinitely at no cost. We reserve the right to modify the free plan's features with 30 days' notice.

4-Month Promise

After 120 days of active daily use on the free plan, LUMINA Pro will be offered to you for activation with one tap at no cost for a promotional period. "Active daily use" means using the LUMINA app on at least 100 of the 120 days. The promotion may be modified at any time with 30 days' notice.

Pro plan (€9.99/month)

• The Pro plan is billed monthly at €9.99 including VAT.
• Payment is processed securely by Stripe. We never store your card details.
• Your subscription renews automatically unless cancelled before the renewal date.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for the remaining period unless required by law.
• Prices may change with 30 days' notice. Continued use after the effective date constitutes acceptance of new pricing.

Refunds

Under EU consumer law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of your first Pro subscription. To exercise this right, contact billing@ushvibes.com within 14 days. Refunds will be processed within 14 days. After 14 days, refunds are at our discretion.

Family and Enterprise plans

Family (€19.99/month) and Enterprise (€49/month) plans are available. These are subject to the same payment and cancellation terms as Pro, plus any additional terms provided at the time of subscription.

5. Acceptable Use

You agree not to use LUMINA to:

• Violate any applicable law or regulation
• Harass, threaten, or harm any person
• Attempt to circumvent security measures or rate limits
• Access another user's data or account without authorisation
• Upload malicious code, viruses, or exploits
• Use automated tools to scrape, crawl, or extract data from LUMINA
• Attempt to reverse-engineer, decompile, or disassemble any part of LUMINA
• Use LUMINA to generate content that is illegal, hateful, defamatory, or infringes third-party rights
• Misrepresent your identity or impersonate another person
• Use LUMINA for any commercial purpose other than your personal use without our written consent
• Attempt to overload our systems with excessive requests beyond normal use

Violation of these terms may result in immediate account suspension or termination without notice or refund.

6. Your Content

Everything you share with LUMINA — your conversations, goals, moods, and reflections — remains your content. You retain full ownership. You grant USHVIBES OÜ a limited, non-exclusive, royalty-free licence to process your content solely for the purpose of delivering the service to you.

We do not use your personal conversations to train AI models. We do not sell or share your content with third parties beyond the providers listed in our Privacy Policy.

You are responsible for the content you share. Do not share content that is illegal, infringes third-party rights, or violates these Terms.

7. Intellectual Property

LUMINA, its name, logo, design, features, Morning Illumination™, Resonance Score™, Echo™, Mood Weather™, Life Chapters™, Dream Compass™, Living Memory™, and Daily Spark™ are trademarks and intellectual property of USHVIBES OÜ. All rights reserved.

You may not copy, modify, distribute, or create derivative works of LUMINA or any part of it without our written permission.

LUMINA-generated content (briefings, Echo poetry, Life Chapters) is created for your personal use. You own the personal data within it, but USHVIBES OÜ retains the copyright in the generated text format. You may export and keep this content for personal use.

8. Important Disclaimers

• LUMINA is an AI-powered life companion. It is designed to provide support, encouragement, and personalised guidance — not professional advice.
• Nothing LUMINA says constitutes medical advice, psychological diagnosis, financial advice, or legal counsel.
• If you are experiencing a mental health crisis, suicidal thoughts, or require urgent help, please contact emergency services (112 in Europe) or a crisis helpline (142 in Austria — free, 24/7) immediately.
• LUMINA uses AI that may occasionally produce inaccurate, inconsistent, or inappropriate responses. We make no warranty that responses will always be accurate, complete, or suitable for your situation.
• LUMINA is provided "as is" and "as available" without warranty of any kind, to the maximum extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by applicable law (including EU consumer protection law which cannot be excluded):

• USHVIBES OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
• Our total liability to you for any claim arising from these Terms or the service shall not exceed the amount you paid to LUMINA in the 12 months preceding the claim.
• We are not liable for service unavailability caused by circumstances beyond our reasonable control (force majeure).

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under EU or Austrian consumer law.

10. Termination

By you

You may delete your account at any time via Settings → Delete Account. This immediately and permanently deletes all your data. Active Pro subscriptions should be cancelled before deletion to avoid further charges.

By LUMINA

We may suspend or terminate your account with immediate effect if you breach these Terms, engage in fraud, abuse the service, or if we are required to do so by law. For minor or first-time breaches, we will generally warn you first. We will not terminate accounts without good reason.

If we terminate your account for reasons other than your breach, we will provide a pro-rata refund of any prepaid subscription.

11. Disputes and Governing Law

These Terms are governed by Estonian law, supplemented by EU consumer protection law where applicable. EU consumers retain all rights afforded by the mandatory consumer protection laws of their country of residence.

We encourage you to contact us first at legal@ushvibes.com to resolve any dispute informally. If a dispute cannot be resolved informally:

• EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
• Austrian consumers may contact the Austrian Consumer Arbitration Board (Verein für Konsumenteninformation)
• Any legal proceedings shall be brought in the courts of Tallinn, Estonia, or the courts of the user's country of residence for EU consumers

12. Changes to These Terms

We will notify you of material changes to these Terms by email and in-app notification at least 30 days before the changes take effect. Minor changes (corrections, clarifications) may be made without notice. The date at the top of this page will always reflect the last update.

Your continued use of LUMINA after the effective date of updated Terms constitutes your acceptance of the changes. If you do not accept the new Terms, you must stop using LUMINA and may request account deletion.
